The « SAS Huit » with capital of 2.000Euros, whose head office is located 11 square Jules Ferry, 56100 Lorient, registered on the Register of Commerce and Companies of Lorient under the SIREN number 537 391 708, whose activity is the exploitation of a service of management of promotional offers closed with local partners, especially via the www.unlimited-card.com website. These general terms of use define the conditions of use of the www.unlimited-card.com website.
These general terms of use apply from the first use of the UNLIMITED CARD services by the member. The use of the www.unlimited-card.com website involves the acceptance of these conditions.
Article 2 – Definitions
“Member”: refers to any natural person, over the age of 18 and capable of discernment, holder of the “UNLIMITED CARD” card using the services offered by UNLIMITED CARD through the www.unlimited-card.com website and the “UNLIMITED CARD” card.
“Partner”: refers to the shops in which the Members can benefit from promotional prices and/or from gifts by identifying to them, while their purchases, with their “UNLIMITED CARD” card. The partners are referenced, from the date of purchase, by the SAS Huit in the list of the partner shops, available for consultation at any time, by the Member, on the www.unlimited-card.com website, when they identify themselves with their login and password. The list of partners can be modified at any moment by and in accordance with them. To register to the www.unlimited-card.com website, the Member must be an UNLIMITED CARD card holder.
“UNLIMITED CARD card”: refers to the UNLIMITED CARD card that the Members can buy in one of the UNLIMITED CARD partner shops. The UNLIMITED CARD card allows the Members to identify themselves to the UNLIMITED CARD Partners and consequently to benefit from services proposed by UNLIMITED CARD and his Partners. To benefit from the UNLIMITED CARD partners’ offers, the Member must show his card for all his purchases. It is expressly agreed that the UNLIMITED CARD card can’t in any case allow the transfer of funds and is not a mean of payment. The UNLIMITED CARD is valid for 1 year from the date of purchase. At the end of the term, the Member can extend the advantages of his card by renewing it. In the event of loss or theft of the UNLIMITED CARD card, the card will not be refunded or exchanged. UNLIMITED CARD reserves the right to modify at any moment the terms of us of the present card. Every card is unique, individual and is identified by a number written on the front of the card.
“Member account”: refers to the account opened by every member with UNLIMITED CARD, after having filled the registration while his first connection to the www.unlimited-card.com website and which gathers together the different offers of the partners. When it is done, UNLIMITED CARD will give to his Member a password to access to his account. This password will be sent by email. To register on the www.unlimited-card.com website, the Member must own his UNLIMITED CARD card to identify himself on the www.unlimited-card.com website by his unique number written on the front of his card. The Member can access to his account trough the « My account » tab on the site www.unlimited-card.com website in order to fill and/or modify the information about him (e.g.: password).
“The website”: refers to the website created by the SAS Huit, reachable at the address: www.unlimited-card.com and which gathers together the local offers, the “Private sales” and national Partners of UNLIMITED CARD, selected by the SAS Huit.
“Private sales”: refers to the local and/or national of UNLIMITED CARD Partners’ offers valid for a specified period and depending on the available quantities. The “Private sales” are reachable on the www.unlimited-card.com website, via the « Private sales » tag.
Article 3 - Object
The www.unlimited-card.com website purpose is to promote the sales of products, services, leisure or events proposed by the referenced Partners and selected by the SAS Huit, and all additional activities. To have an access to the UNLIMITED CARD and his Partners offers, the member must be a holder of an UNLIMITED CARD card and create his Member account while its first connection on the www.unlimited-card.com website.
The first use of SAS Huit services, through his UNLIMITED CARD card and the www.unlimited-card.com website leads to the acceptance without reservations of the specifications of the general conditions of use by the Member.
Article 4 – The member account
4.1 Opening of a member account
After the acceptance of the general condition of use by the member, while his first connection on the website, UNLIMITED CARD opens in his books a member account for every persons who owns an UNLIMITED CARD card. The creation of a member account is done online, on the www.unlimited-card.com website, for every person who owns an UNLIMITED CARD card.
4.2 Member account functioning
While his first connection, the Member has to copy the number written on the UNLIMITED CARD into the space provided and fill the online form resuming all the necessary information to his identification, including the last name, first name, electronic address, postal address, mobile phone number, birthday date, hobbies. In a second time, once the form is filled and the general conditions of use read and accepted, the Member will receive, on his electronic address given in the form, an email indicating his password and login. The Member can at any moment modify and/or complete the information in his account.
Once activated, the Member account allows him to see the UNLIMITED CARD and Partners offers and services.
4.3 Member account consulting
The member can at any time consult and/or modify the information about his Member account on the website using his personal and secret login and password that UNLIMITED CARD gave him and whose he is liable for.
Article 5 –« Unlimited Card » card
Any natural or legal person can obtain an UNLIMITED CARD card offered by a third party or by buying it from one of the UNLIMITED CARD Partners by paying the annual subscription at the current price at the subscription date. The UNLIMITED CARD card allows an UNLIMITED CARD member to identify himself to the Partners to benefit from promotional offers and/or gifts when they purchase goods and/or services. The UNLIMITED CARD is strictly personal, it must be used individually. It can’t be transferred or lent to a third party. It is valid for one year. In case of loss or theft of the UNLIMITED CARD card, the Member must declare it by letter sent to SAS HUIT - UNLIMITED CARD – 11 square Jules Ferry – 56100 LORIENT or declare the loss or theft by electronic means at the following address: contact@unlimited-card.com. In case of loss or theft of the UNLIMITED CARD card, the card will not be refunded or exchanged.
Article 6 – Partners offers and referencing
6.1 General provisions
The welcome offers of goods and/or services proposed on the www.unlimited-card.com website are valid for a specified period. The description of the provision of services, products, leisure, event or promotional offers of the UNLIMITED CARD Partners on the www.unlimited-card.com website is the one that UNLIMITED CARD is aware of at the moment of the online input. The information can evolve and be modified. The pictures uploaded are an illustration of our offers and give a real overview of the services proposed. However, the pictures uploaded are only illustrative and doesn’t commit UNLIMITED CARD. UNLIMITED CARD proceeds to the Partners referencing on the website and to the negotiation of products and/or services advantages. UNLIMITED CARD reserves the faculty to change Partners, on condition of respect of potential current contracts, if these one were not satisfying the Members anymore. The goods and/or services offers proposed on the www.unlimited-card.com website are valid as long as they remain online. UNLIMITED CARD cannot in any circumstances be liable if an offer is no longer available with a Partner, if UNLIMITED CARD has not been informed. UNLIMITED CARD practices a referencing activity and does not proceed to any products and/or services purchase on behalf of its Members. The products and/or services purchases made by the Member to the Partners referenced by UNLIMITED CARD remain in any circumstances the responsibility of the concerned Member and/or Partner, especially in terms of general conditions of purchase and/or sales, orders, specification, volumes, periods, delivery mode, invoicing, settlement and treatment of a potential dispute. The member can inform UNLIMITED CARD, as soon as possible, of any difficulty encountered with any of the UNLIMITED CARD referenced Partners. UNLIMITED CARD cannot, under any circumstances, be liable regarding the Member of non-execution and/or lateness in the performance of the purchase contract between a Member and the Partner. UNLIMITED CARD does not enter into any commitment regarding the availability of goods and services referenced by its Partners. It is understood that on request of the Member, UNLIMITED CARD will provide, within its means, its support and help to solve any execution difficulty that could appear between the Member and the referenced Partner.
6.2 Purchase procedure by the Member.
The Member goes directly on the UNLIMITED CARD Partners’ shop, selects the products that he wants to buy and presents his UNLIMITED CARD card at the checkout. It’s the Partner who takes the responsibility to check the validity of the UNLIMITED CARD card of the Member while the purchase procedure. The Partner can ask the Member to presents his identity card in order to check that the Member really is the holder of the card. The goods and/or services bought by the Member to Partners are sold, according to the Partners, in a shop and/or, if necessary, on the Partner’s website, at the recommended public price shown in the shop on the day of purchase, before deduction of the discounts related to the UNLIMITED CARD Member’s reserved offer who he will benefit by presenting their UNLIMITED CARD at the checkout.
Article 7 – Sponsorship
The website reserves the possibility to organize sponsorship campaigns, whose modes will be given on the website while their organization. In case of fraud or use of automatic technical means that allows sponsorships or automatic subscriptions, no sponsorships or subscriptions will be accepted.
Article 8 – UNLIMITED CARD card expiry and extension
The UNLIMITED CARD card is valid for a year. When it expires, the Member will be able to renew the advantages of his UNLIMITED CARD card by buying a new one to one of the UNLIMITED CARD partners or by payment on the website of the current membership amount at the date of extension.
Article 9 – Cancellation
UNLIMITED CARD reserves the faculty to close an UNLIMITED CARD Member account in the case of fraudulent or illegal use of the UNLIMITED CARD services and/or offers or in the case of Member failure to any of the clauses of the present general conditions of use. The closure of an UNLIMITED CARD Member account that follows will intervene after the sending by SAS Huit of a registered letter with advice of receipt remained without effect 15 days after the receipt concerning the failure or remained without justification of the lawfulness or non-fraudulent of the use of the service. While this period, the functioning of the UNLIMITED CARD Member account will be adjourned. Constitute particularly illegal or fraudulent use of the UNLIMITED CARD services and/or offers the following cases: - False statements while the opening of the Member account; fraudulent use of the UNLIMITED CARD card by a Member non-holder of the specific card; resale of the UNLIMITED CARD card to a third party.
Article 10 – Liability
The SAS Huit cannot be liable in case of unavailability of the referenced goods and services by its Partners. The Partners are exclusively liable for the goods and services they sell. The SAS Huit, through its brand UNLIMITED CARD only practices an activity of referencing and does not proceed to any purchase of Products and/or Services. The purchases of Products and Services realized by the Member to Partners referenced by UNLIMITED CARD remain in any circumstances the exclusive responsibility of the Member and/or concerned Partners, especially in terms of general conditions of purchase or sale, orders, specifications, volumes, periods, delivery mode, invoicing, regulation and settlement of claims and potential disputes. The refusal of a discount or any other failure of a Partner cannot lead to the incurrence of the SAS Huit liability.
Article 11 – Force Majeure
None of the parties shall be held liable about the other for the non-performance of a duty provided by the present general conditions that would be due by the incidence of a force majeure case as defined by the Civil Code and usually admitted by the jurisprudence.
Article 12 Information technology and Liberties
The Members are informed that the personal data collected while their subscription on the website are used for the Member account management opened to UNLIMITED CARD, the creation of commercial statistics, the optimization of the access to every services and/or offers proposed by UNLIMITED CARD. Unless otherwise specified, the Member authorizes SAS Huit to use his contact details and especially his postal address, his email address, his fixed-line phone and mobile phone numbers to communicate commercial offers about their services. The recipients of these data are the SAS Huit services when the Member authorized it; the SAS Huit reserves the possibility to convey those personal data to its commercial Partners. According to the data protection act of January 6th, 1978, any Member has a right of access, correction and the withdrawal of the personal data concerning them to UNLIMITED CARD as well as a right of to object the receipt of those messages. To exercise those rights, simply inform the SAS Huit by registered letter in proving your identity, to the SAS Huit - 11 Square Jules Ferry - 56100 LORIENT, or send an email to: contact@unlimited-card.com.
The Members are also informed that cookies can be installed on their computer in order to ease the browsing on our website. The cookies can be removed following the procedure planned by the Member browser.
Article 13 – Transfer
The Members explicitly recognized that the rights arisen from the general conditions of use present could be sold, transferred by any means, by the SAS Huit to any company of its choice.
Without the need to respect the formalism of the articles 1689 and following of the Civil Code, the Members will be held to all their obligations regarding the concessionary of the SAS Huit rights that they recognize and accept strictly and definitively.
Article 14– Independence of the clauses
In case the all or part of a clause of the present general conditions of use is found null and void, non-invocable, it will be considered non-written, will have no effect on the others clauses which are independent from one another. The parties, by mutual agreement, may agree to replace the invalid specifications by a clause reflecting their real intention. The temporary or continuing waiver of the fact, of the SAS Huit, to practice any of the rights arisen from the presents cannot constitute a renunciation or consent to any other failure of Members.
Article 15 – The applicable Law and Settlement of disputes
The present general conditions of us, as well as the acts resulting from it are subjected to French law. In case of dispute coming from the interpretation or the execution of the general conditions of use, the Parties commit themselves to seek an amicably solution. If such an amicable solution cannot be found, the disagreement will fall within the French exclusive jurisdictions
